Instructions for Use and Provision of “GreenLine” International Communication Services

1. Terms Used

* terms mentioned below with accompanying interpretation are used for all services provided by CM if only otherwise not stated in the present Instructions

1.1. Operator: “Greenlinetoursgroups” L.L.C., hereinafter referred to as CM, legal address: 67 Kurmangazy Street, Almaty, Republic of Kazakhstan, the company provides services of mobile communication and distribution of “GreenLine” mobile roaming communication prepaid cards.

1.2. SUBSCIBER: natural or legal person using “GreenLine” card..

1.3. “GreenLine” card (hereinafter referred to as SIM card): a prepaid card provided for receiving the Communication Services in the amount of moneys (Prepayment) paid into the card account, which is an electronic device with a memory that stores data necessary for identification and authentication of the Subscriber in GSM network and providing the Subscriber with possibility to receive Services rendered by the Operator.

1.4. Connection Number: phone number assigned to the Subscriber of SIM card.

1.5. Communication Service: activity of reception, processing, storage, transmission and delivery of signs, signals, written text, images and sounds via communication network of the Operator. This term gives an idea of main services rendered by the Operator but does not limit them. Hereinafter the term Communication Service implies all services provided by the Operator with the help of SIM card.

1.6. Description of Services: publicly available information about possibilities to use services, tariffs and procedure for connection and disconnection of services as well as other related information.

1.7. Prepayment: monetary funds entered in the Subscriber’s SIM card Balance when replenishing the Subscriber’s SIM card Balance in accordance with the present Instructions. The paid prepayment may be spent for reception of Communication Services within effective period of SIM card specified in accordance with the present Instructions.

1.8. SIM card Face Value: - SIM card purchase cost specified by the Operator, of which amount will be entered in the Subscriber’s SIM card Balance at the time when SIM card is activated. SIM cards may have different face values.

1.8. Bonus - additional monetary funds entered in the Subscriber’s SIM card Balance at the Operator’s initiative in accordance with marketing actions and other campaigns carried out by the Operator, information on which will be publicly available on the Website. Bonuses may be realized for receipt of Communication Services within the effective period of SIM card and/or in accordance with provisions of marketing actions and other campaigns carried out by СМ.

1.9.“GreenLine” Starting Kit: Primary “GreenLine” kit including: SIM card, information about PIN and PUK codes.

1.10.Activation of SIM card: – SIM card is automatically activated when the Subscriber uses it for the first time to make a call or send SMS.

1.11.SIM card Balance: electronic account in the Billing System of the Operator which reflects the sum of Prepayment amounts entered by the Subscriber in the given SIM card and the volume of Communication Services rendered.

1.12.Code PIN 1: security code of four symbols designed for protection of the Subscriber’s SIM card against unauthorized use.

1.13.Code PUK 1: 8-unit security code designed for unblocking of SIM card if it was blocked by triple entry of wrong PIN 1.

1.14.Tariffs: pay for Communication Services specified by the Operator.

1.15.Certified phone set: telephone set designed for operation in GSM system.

1.16.Bank: credit institution carrying out the emission of Bank Cards.

1.17. Bank card: payment or credit card issued by credit institution, being an instrument for non-cash settlements and designed for performance of operations with monetary funds available on the Subscriber’s Bank Account.

1.18.Billing system - automated electronic system of the Operator for accounting of operations on providing the Subscriber with Communication Services and payment thereof.

1.19. Internet - global system of voluntarily joined computer networks which is built basing on the use of IP protocol and routing of data packets.

1.20. Payer - Bank card holder being the User, who initiates the transmission via Internet of his instruction to the Bank on money transfer for payment of Communication Services by means of Internet payment.

1.21. Internet payment - payment for Communication Services carried out by the Payer (the Subscriber) via the Internet.

1.22. Website — a collection of informational resources and administration means posted on the Internet at the address: www.greenline168.com.

1.23. Personal room a system of connection and administration of Communication Services created by CM and posted on the Website, providing the Subscriber with direct access to CM Communication Services and their administration.

2. General Instructions

2.1. These instructions (hereinafter referred to as “the Instructions”) establish a procedure for provision of Communication Services and use of SIM card.

2.2. The Operator shall render Services only under Prepayment conditions and only within the Prepayment amount if not otherwise stated in a separate agreement concluded between the Operator and the Subscriber. Face value of SIM card shall be specified by the Operator. Various SIM card Face Values are shown on the Website in section “Buy Service”: www____________. Prepayment amount when replenishing the account shall be specified by the Operator. Prepayment amounts are indicated on the Website in section “Replenishment of SIM card Balance”: www ______________.

2.3. Communication Services provided by the Operator shall not require a separate written agreement.

2.4. The Instructions shall apply to the Subscriber from the time of SIM card acquisition.

2.5. The Subscriber shall not have a liability to renew the amount of Prepayment after it has been spent.

2.6. The Operator shall only provide Communication Services in countries included in the list of countries shown on the Website at www.___________________/

2.7. Description of Communication Services provided by the Operator is available on the Website at .___________________. The Operator shall be entitled to bring amendments into description of Communication Services and into these Instructions. Information about such amendments will be posted on the Website and at SIM card outlets thirty days before these amendments come into effect.

2.8. The Operator shall be entitled to bring any changes into the Instructions, which are associated with the improvement of the Subscriber’s position, without a special warning.

2.9. By acquisition of SIM card the Subscriber shall confirm that he/she has been acquainted with and agrees to the Instructions and description of Communication Services.

3. Beginning, Cancellation and Renewal of Communication Services.

3.1. The Subscriber may start using the Communication Services within one hour from acquisition of SIM card and entry of PIN 1 code. To use individual Communication Services, the Subscriber may need to take some additional steps in accordance with description of Communication Services (p. 2.7.)

3.2. The Operator shall have the right to discontinue or completely cease the provision of Communication Services without a special notification to the Subscriber in case if:

3.2.1. Prepayment amount on the Subscriber’s SIM card Balance is not sufficient for provision of Communication Services.

3.2.2. The Subscriber has received Communication Services in volume exceeding the Prepayment amount on the Subscriber’s SIM card Balance.

3.2.3. The Operator has substantiated suspicion that the Subscriber is using the Communication Services for unlawful purposes, including distribution of commercial information being prohibited for postings and involving the right to intellectual property or being undesirable for its recipients (SPAM) etc.

3.2.3. The Subscriber’s connection number is used for generation of interferences in the Operator’s network and/or other telecommunication networks or against other Subscribers.

3.2.4. The Subscriber’s connection number is used for organization of communication flow (traffic) of other operator into the Operator’s network or into other networks with the use of the Operator’s network.

3.2.5. The Subscriber did not use the Communication Services within one year of SIM card acquisition or of last use of Communication Services. In this case the Operator shall have the right to deactivate SIM card and use the connection number at his own discretion after one month since expiry of one-year period.

3.3. In cases mentioned in Paragraphs 3.2.1. and 3.2.2. the Operator will renew provision of Communication Services to the Subscriber as soon as the Prepayment has arrived at SIM card Balance.

4. Instructions for Use

4.1. Rights of the Subscriber:

4.1.1. Receive information about Communication Services, their description and use, quality, tariffs and payment methods. Said information may be received on the Website at www.greenline168.com or by calling to the Support Service phone indicated on the Website.

4.1.2. Submit to the Operator written claims and applications on Communication Services in accordance with procedure established by the Operator.

4.1.3. Inform the Operator in writing (or with the use of identification signs assigned to the Subscriber when registering on the Website, by means of the Website resources) about theft or loss of SIM card and request for its deactivation.

4.1.4. Receive, free of charge, a detailed bill for the spent Prepayment in accordance with procedure established by law.

4.2. Liabilities of the Subscriber:

4.2.1. Use the Communication Services in accordance with requirements of legislation and the present Instructions.

4.2.2. Only use equipment (mobile phones) that meets specifications and requirements of legislation. The Operator shall not be held responsible for quality of Communication Services in case if the Subscriber uses nonconforming equipment.

4.2.3. Inform the Operator in writing (or with the use of identification signs assigned to the Subscriber when registering on the Website, by means of the Website resources) about loss (including theft) of SIM card. Until receipt of such notification the Operator shall have the right to provide Communication Services at the Subscriber’s expense.

4.2.4. Become acquainted with the present Instructions, description of Communication Services, Tariffs and other information about Communication Services available on the Website.

4.3. Rights of the Operator

4.3.1. The Operator by 30-day prior warning to the Subscriber shall be entitled to:

4.3.1.1. Change the Subscriber’s connection number.

4.3.1.2. Discontinue providing any of the Communication Services or discontinue providing the Communication Services within a certain territory.

4.3.1.3. Carry out necessary works associated with technical service, modification of network and/or equipment, with temporarily discontinued provision of the Communication Services for the time of performance of such works.

4.3.1.4. Modify Tariffs, Instructions and description of Communication Services.

4.3.2. Discontinue providing the Communication Services without notification to the Subscriber in cases specified by the Instructions.

4.3.3. Deactivate SIM card and use the connection number at own discretion in cases specified by the Instructions.

4.3.4. Send, by means of electronic communication means, information of various kind to connection number assigned to the Subscriber. Such information shall be considered binding for the Subscriber and is equaled to information sent in writing.

4.4. Liabilities of the Operator

4.4.1. Provide the Subscriber with the Communication Services in accordance with the Instructions and requirements of legislation.

4.4.2. Provide the Subscriber with a possibility to get acquainted with the Instructions and other information about the Communication Services.

4.4.3. Consider written claim of the Subscriber and reply to it in accordance with the Instructions and requirements of legislation.

5. Procedure for Consideration of Claims and Disputes

5.1. The Operator shall examine and within dates established by law shall give reply to written claims of the Subscriber on nonconformity of Communication Services with the Instructions and/or description of Communication Services (consumer claims). In all other cases the Operator shall reply to claims and applications of the Subscriber within 30 days from receipt of relevant claim or application provided no additional time is required for solution of the issue.

5.2. The Subscriber shall be entitled to present claims and/or information to the Operator in relation to spending of Prepayment not later than within three months after the last usage of the Communication Services and/or upon termination of time period for which the Subscriber requires a report.

5.3. All disputes and disagreements between the Operator and the Subscriber shall be settled by the way of negotiations for the beginning of which a written application from the Subscriber is required. In case when settlement of a dispute by the way of negotiations is impossible, such dispute shall be referred for consideration by a court of the Republic of Kazakhstan.
